Summary
1. On June 7, 2007 Sutts, Strosberg LLP commenced a proposed class action against Advanced Medical Optics, Inc., the American manufacturer, and AMO Canada Company, the distributor of Complete All-in-One MoisturePlus contact lens solution (“Complete”). The proposed class action was commenced at Windsor, in the Ontario Superior Court of Justice.
2. This product has been widely sold in Canada since the early 1990s for the disinfection and lubrication of soft contact lenses.
3. On May 28, 2007 AMO Canada Company announced a total recall of all Complete products due to strong linkage with an outbreak of Acanthamoeba Keratitis (“AK”). AK is a serious eye infection which causes ulceration of the cornea of the eye and can cause loss of vision requiring a corneal transplant. AK is caused by an amoebic parasite associated with contaminated water. The incidence of actual infection appears to be small, however, many individuals may require testing.
4. In the recall announcement, consumers were told to stop using Complete immediately, and to discard lenses and containers used with Complete. Simultaneously, Advanced Medical Optics, Inc., announced an identical recall in the United States.
5. The action has been commenced on behalf of:
(a) people who contracted AK or had to undergo testing for AK and used Complete; and
(b) people who had monetary losses for the replacement of property that had to be discarded.
